\"\"Prime Minister of Pakistan should be held accused of Contempt of Court or the Chief Justice of Pakistan needs to review his rulings issued so far in connection with the Election in Punjab is the main topic being discussed in political circles of the country. I have been writing and speaking that CJP is more wrong than Prime Minister \/GoP in ongoing tussle between the two pillars of the state. Neither PM\/GoP is ready to change their stance nor CJP seems to consider the pleas of the GoP\/Election Commission of Pakistan. On 18 April, the country was expecting or apprehending the disqualification of the sitting Prime Minister in contempt of court for not releasing funds for elections in Punjab but to their dismay or astonishment, no such decision came from the SCP Bench. What happened in between?<\/strong><\/span><\/h4>\n<\/div>\n
What happened in between? This Supreme Court and Chief Justice seat has a dark history of disqualifying the sitting Prime Ministers (Chief Justice Saqib Nisar\/ Nawaz Sharif – Chief Justice Iftekhar Chaudhary \/Yousuf Raza Geelani). What is the obstacle in case of Prime Minister Shehbaz Shareef for Chief Justice Umar Ataa Bandyaal? He is careful? Afraid of the reaction? Afraid of what happened with Chief Justice Sajjad Ali Shah?<\/h5>\n
What is the reason by the way ? The reasons mentioned above or the meeting of ISI and Military officers with Chief Justice only a day earlier than the final hearing? Director General Inter services Intelligence Lt General Nadeem Anjum, Director General Military Operations, Secretary Defense briefed Chief Justice of Pakistan about the ongoing operations in different parts of country against the terrorists. Certainly they meant in short that the military personnel are not available for election duty on the date fixed by Chief Justice of Pakistan. Now it is another big question for Chief Justice of Pakistan that he is unaware of what is happening around with regard to the internal security of the country?<\/h5>\n
Election Commission earlier on 14 April and latest on 18 April both times submitted that the security situation is not satisfactory in Punjab and KPK. Elections can bring more disturbance, anarchy and chaos. Election Commission presented its final report that no funds have been received from the government. And elections on one day will be the best option for the sake of the country. Earlier on Monday ,Military and Military Intelligence officials briefed the Chief Justice and companion judges of the disputed bench that the military personnel engaged in operations will be available only after 6 months at least. Parliament has already rejected the government’s requisition to approve the release of the funds.<\/h5>\n
Parliament is determined to stand firm on its own side of version. Parliament is playing its cards in more aggressive but reasonable manner. The public accounts committee of the National Assembly has pointed out that Supreme Court has not allowed its audit in last 10 years. The account officer of SCP has been summoned by PAC after this Eid. It is a big blow to the tall claims of justice and rule of law from the Mr. s Justices. (I dont know how to write the plural of Mr. with Justices. Writing s for plural makes Mrs that can put me behind the bars for contempt of court.)<\/h5>\n
Now the political picture is, the Parliament, Election Commission and Military are not for snap election in Punjab and KPK while Chief Justice is bent upon holding the election on his fixed date and that in Punjab only but not in KPK that is another weak point of Chief Justice of Pakistan.<\/h5>\n
I noted on the first day of the decision of Chief Justice that what decision it is? Election in Punjab in 90 days and for election in KPK , go to the relevant forum. Which forum by the way and why when Supreme Court’s Chief Justice has taken suo moto on the elections in the provinces where the assemblies have been dissolved.Chief Justice issued open ended decision that time, ” Elections should be held in 90 days and if necessary to postpone , do it for the shortest period of time.” Who will decide how short?<\/h5>\n
Again when Chief Justice fixed the case second time in his own selected bench , another disputed decision was the only outcome that election in 90 days only in Punjab. I have been noting since the first hearing of the case that ” Firstly Chief Justice should not have taken suo moto on a purely political matter, if done then observe the point ” Why assemblies were dissolved? What was wrong there? Assemblies should be dissolved on the behest of a single person only? Is it constitutional to dissolve the legislatures to satisfy the personal ego of a person who is happened to be the head of the party\/alliance of the Chief Ministers of the provinces?<\/h5>\n

This time there is only one difference. Military has conveyed the message in the most reasonable and rational manner with due respect by giving detailed briefing to the Chief Justice of Pakistan. Now it depends upon the Chief Justice how he responds to the gestures of convincing him rather giving any strict call.<\/h5>\n
Another problem for the Chief Justice is how to revisit what has already been done. It can only be undone in the process of hearing the case only. Can Chief Justice of Pakistan listen to same voices? Can he revisit his decisions?<\/h5>\n
Certainly it is highly humiliating for a Chief Justice of the Superior Judiciary. Then, he will quit the bench ? or quit the court? Justice Sajjad Ali Shah asserted his role and position but finally he had to resign taking the President with him.<\/h5>\n
Chief Justice Bandyal will come back from the dark tunnel or move forward to go into the history? And will take President Arif Alvi with him? Or he will at any cost, convict the sitting Prime Minister for contempt of court to disqualify him for the slot? Curtain is raising soon.<\/h5>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
