Islamabad\/Pakistan; Foreign Ministry of the Government of National Accord Libya has strongly condemned the recruitment of children under 15 years by General Hafter to fight against their own countrymen a war in which no one will be winner. In a statement released from Tripoli and shared in Islamabad, Foreign Ministry has called upon the international community and the United National to bear their legal and humanitarian responsibilities vis-a-vis these acts, and invites them to take necessary and decisive measures to out this aggression and bring such a heinous act to an end.\"\"File Photo; Mr. Taher Sayala MFA Libya<\/p>\n

Statement by the Foreign Ministry read as follows;<\/p>\n

In light of the Hafter Forces’ aggression on Tripoli, regardless the international and regional calls to stop this, his insistence to pursue the aggression by mobilizing all means in an attempt to make his attack on Tripoli successful, and in a serous precedence, it is been undoubtedly proven to us that he is using children by putting them into the midst of war, in violation of provisions of all international norms and conventions including the Geneva Four Convention of 1949 on non-international armed conflicts, wherein Article 4 of the Additional Protocol 2 annexed to those Conventions stipulates<\/p>\n

” Children who have not attained the age of fifteen years shall neither be recruited in the armed forces or groups nor allowed to take part in hostilities”.<\/p>\n

The Optional Protocol, adopted by virtue of Resolution No; 263 by the UN General Assembly during its 54th Session on 25 May 2000- put into effect on 23 Feb, 2002 and ratified by 142 states, also stipulates that
\n“Children under 18 may not be recruited into the armed forces”.<\/p>\n

In addition, and by virtue of Article 8 of the Rome Statute of the ICC,<\/p>\n

“The conscription or enlistment of children under the age of 15 years or using them to participate actively in hostilities”<\/p>\n

is considered as a war crime. Within this framework, the UN General Assembly has adopted the two Optional Protocols of the Convention on the Rights of the Child;
\nProtocol 1 on the involvement of children in armed conflicts, and
\nProtocol 2 on the sale of children, child prostitution and child pornography.
\nArticle 4 Protocol 1 stipulates the following;<\/p>\n

1- Armed groups that are distinct from the armed forces of a State should not, under any circumstances, recruit or use in hostilities person under the age of 18 years.<\/p>\n

2-States’ Parties shall take all feasible measures to prevent such recruitment and use , including the adoption of legal measures necessary to prohibit and criminalize such practices.<\/p>\n

3- The application of the present article shall not affect the legal status of any party to an armed conflict.<\/p>\n

While the Foreign Ministry of the Government of National Accord condemns these crimes, which are among a series of crimes of this war, calls upon the international community and the United National to bear their legal and humanitarian responsibilities vis-a-vis these acts, and invites them to take necessary and decisive measures to out this aggression and bring such a heinous act to an end.<\/p>\n
