This Reporters Without Borders (RSF) investigation discovered that at least 15 media outlets worldwide received these notices, and five have been subjected to legal proceedings. RSF strongly condemns these gag lawsuits.<\/h5>\n<h5 dir=\"ltr\">Rajat Khare is ready to move mountains to avoid association with Appin, the cybersecurity training centre he co-founded in 2003. And for good reason: the New Delhi-based company has been accused of selling less-than-ethical hacking\u00a0services, according to well-researched journalistic investigations from prominent publications, including the US magazine\u00a0<em><u>The<\/u><\/em><u>\u00a0<\/u><em><u>New Yorker<\/u><\/em><em>\u00a0<\/em>and the British news agency\u00a0<em><u>Reuters<\/u><\/em>.<\/h5>\n<h5>Since 2022, articles, newsletters and podcasts from at least 15 different media outlets have been modified or withdrawn as a result of the notices and legal charges brought forth by Khare or the Association of Appin Training Centers<em>\u00a0<\/em>(AOATC), an obscure entity claiming to defend Appin\u2019s interests and reputation. The magnitude of these gag lawsuits \u2014 known as strategic lawsuits against public participation (SLAPPs) \u2014\u00a0is unprecedented.<\/h5>\n<h5 dir=\"ltr\">\u201cIf it becomes known that a powerful person can use the Indian court to strike down articles all over the world, everybody will do it. So it&#8217;s a big deal [&#8230;] and if they succeed, they&#8217;ll do it everywhere,\u201d said a source familiar with Khare\u2019s tactics, speaking on condition of anonymity. The source expressed deep concern about the potential consequences of the intimidating letters and prosecutions brought by Appin and its wealthy co-founder against media outlets.<\/h5>\n<blockquote class=\"wp-embedded-content\" data-secret=\"uHQwKMmVkE\"><p><a href=\"https:\/\/pakistanintheworld.pk\/live\/pakistan-in-the-world-july-aug-2024\/\">Pakistan in the World &#8211; July \/ Aug 2024<\/a><\/p><\/blockquote>\n<p><iframe class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"&#8220;Pakistan in the World &#8211; July \/ Aug 2024&#8221; &#8212; Pakistan In the World\" src=\"https:\/\/pakistanintheworld.pk\/live\/pakistan-in-the-world-july-aug-2024\/embed\/#?secret=1j02Hj98Ur#?secret=uHQwKMmVkE\" data-secret=\"uHQwKMmVkE\" width=\"600\" height=\"338\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<blockquote>\n<h5 dir=\"ltr\"><strong><em>\u201cThis Indian entrepreneur and his lawyers have launched an offensive on an unprecedented global scale to keep both himself and his company\u2019s tactics out of the spotlight. Self-censorship, pressure, lawsuits \u2014 close to 15 different media outlets around the globe have removed or modified their content to avoid reprisals. The effectiveness of these SLAPP suits, which lead to self-censorship even when the lawsuit is unsuccessful, poses a serious threat to journalism. We strongly condemn these \u2018serial litigation\u2019 methods and urge the courts to respond to these lawsuits with wisdom and good judgment. We also call on media outlets not to give in to this pressure, which endangers investigative journalism.&#8221;<\/em><\/strong><\/h5>\n<h5 dir=\"ltr\" style=\"text-align: center;\"><strong>Ha\u00effa Mzalouat<\/strong><br \/>\n<strong>Journalist at RSF\u2019s Investigation Desk<\/strong><\/h5>\n<\/blockquote>\n<h5 style=\"text-align: center;\"><strong>Pursued by Indian courts<\/strong><\/h5>\n<h5 dir=\"ltr\"><em>Reuters<\/em>\u00a0tops the\u00a0list of victims of Khare\u2019s legal teams. The British news agency had to wait\u00a0<u>ten months<\/u>\u00a0for a New Delhi district court to reverse, on appeal, a prior decision ordering it to take down an\u00a0<u>investigation<\/u> titled \u201cHow an Indian start-up hacked the world\u201d. Working with hundreds of interviews and thousands of authenticated and verified documents, <em>Reuters<\/em>\u00a0found that Appin had grown from a startup &#8220;to a hack-for-hire powerhouse that stole secrets from executives, politicians, military officials and wealthy elites around the globe.&#8221; A lawsuit brought by the AOATC accused\u00a0<em>Reuters<\/em>\u00a0of tarnishing Appin\u2019s reputation.<\/h5>\n<h5 dir=\"ltr\"><em>The New Yorker<\/em>\u00a0is another prominent victim. The AOATC brought a libel suit against the US magazine over its\u00a0<u>exclusive investigation<\/u>\u00a0into India\u2019s hacking-for-hire industry. The investigation mentions Appin and recounts how Khare offered \u201cethical hacking\u201d services to several European private intelligence firms.<\/h5>\n<h5 dir=\"ltr\">&#8220;<em>The New Yorker<\/em>\u00a0fully stands behind the piece, which is an accurate and fair account on a matter of legitimate public interest. We will continue to defend the right to publish important reporting without fear or favor,\u201d a spokesperson for the magazine told RSF. The article is still online and accessible to everyone \u2013 which is not always the case for other media outlets attacked by Khare or the AOATC.<\/h5>\n<blockquote class=\"wp-embedded-content\" data-secret=\"6NDcfMczJg\"><p><a href=\"https:\/\/pakistanintheworld.pk\/live\/pakistan-in-the-world-aug-sep-2024\/\">Pakistan in the World \u2013 Aug \/ Sep 2024<\/a><\/p><\/blockquote>\n<p><iframe class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"&#8220;Pakistan in the World \u2013 Aug \/ Sep 2024&#8221; &#8212; Pakistan In the World\" src=\"https:\/\/pakistanintheworld.pk\/live\/pakistan-in-the-world-aug-sep-2024\/embed\/#?secret=XQttJYb010#?secret=6NDcfMczJg\" data-secret=\"6NDcfMczJg\" width=\"600\" height=\"338\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<h5 dir=\"ltr\" style=\"text-align: center;\"><strong>The domino effect<\/strong><\/h5>\n<h5 dir=\"ltr\">Several journalists who investigated Appin told RSF that the ten-month-long suspension of the\u00a0<em>Reuters<\/em>\u00a0report sent a very negative signal to investigative reporters \u2014 to the point where journalists preferred to either take down or\u00a0<u>heavily modify<\/u> their coverage of the <em>Reuters\u00a0<\/em>story. For example, the Indian news site\u00a0<em>The Wire<\/em>\u00a0said it \u201cedited\u201d its\u00a0<u>own story<\/u>\u00a0on 18 December 2023. However, when comparing the updated version with the original, RSF found that\u00a0<em>The Wire<\/em>\u00a0had deleted information from\u00a0<em>Reuters<\/em>\u00a0about Khare and Appin.<\/h5>\n<h5 dir=\"ltr\">Some media have even censored themselves before publication \u2014 which has not always sufficed. In February 2024, the American podcast\u00a0<strong><em>Behind The Bastards<\/em>\u00a0<\/strong>dedicated two episodes to Rajat Khare without mentioning his name in the title of the episodes. \u201cWe&#8217;ll see how long these episodes stay up,&#8221; said one of the hosts at the beginning of the first episode. One week later, the episodes disappeared from podcasting platforms:\u00a0<em>Behind The Bastards<\/em>\u00a0had received a letter threatening legal action, according to a source close to the case who wishes to remain anonymous.<\/h5>\n<h5 dir=\"ltr\" style=\"text-align: center;\"><strong>An impressive list of victims<\/strong><\/h5>\n<h5 dir=\"ltr\">Khare had already used these tactics against Switzerland\u2019s public television channel, <em>Schweizer Radio und Fernsehen\u00a0<\/em>(<em>SRF<\/em>), in November 2022.\u00a0<em>SRF<\/em>\u00a0was ordered to provisionally remove Khare\u2019s name and photo from an\u00a0<u>investigative piece<\/u>\u00a0by a lower court in Geneva.<\/h5>\n<h5 dir=\"ltr\">When contacted by RSF,\u00a0<em>SRF<\/em>\u00a0only made broad comments about the case: \u201cGenerally speaking, it can be said that lawsuits and threats of lawsuits are being filed in an attempt to prevent SRF from reporting.\u201d Meanwhile, one of Khare\u2019s Swiss lawyers, Nicolas Capt, told RSF that \u201cIn Switzerland and elsewhere, my client has taken legitimate legal action \u2014 civil and criminal \u2014\u00a0to protect his honour, which has been damaged by false accusations.\u201d Capt added that Khare \u201cdoes not intend to comment on these legal proceedings.\u201d<\/h5>\n<h5 dir=\"ltr\">In the course of this investigation, RSF discovered that the relentless Khare has also tried to sue\u00a0<em>The<\/em>\u00a0<em>New Yorker\u00a0<\/em>in\u00a0<u>Switzerland<\/u>, in addition to the lawsuit against the magazine in India brought by the AOATC.<\/h5>\n<h5 dir=\"ltr\" style=\"text-align: center;\"><strong>The mysterious \u201cX.X.\u201d<\/strong><\/h5>\n<h5 dir=\"ltr\">When the Swiss media outlet\u00a0<em>Gotham City<\/em>\u00a0began taking an interest in the subject in 2022, it was well aware of the risks involved. \u201cWhen we learned of his existence, he had already sued media outlets [&#8230;] and he had won against the Swiss public broadcaster,\u201d said\u00a0<em>Gotham City\u2019s<\/em>\u00a0editor-in-chief Fran\u00e7ois Pilet. \u201cIn this kind of case, we don\u2019t really want to be next in line. What\u2019s more, his lawyers had made it clear to us in advance that they would sue if we published his name.\u201d In the two investigative articles published by\u00a0<em>Gotham City<\/em>, the Indian entrepreneur is therefore referred to as \u201cX.X.\u201d<\/h5>\n<h5 dir=\"ltr\">This did not prevent Khare\u2019s lawyers from ordering\u00a0<em>Gotham City<\/em>\u00a0to modify its reporting. \u201cThe content and tone of your article are deliberately sensationalist and include many factual and erroneous confusions and shortcuts,\u201d wrote Sandrine Giroud, one of Khare\u2019s Swiss lawyers, in a letter seen by RSF.<\/h5>\n<h5 dir=\"ltr\">She added that\u00a0<em>Gotham City<\/em>\u2019s description of Khare was \u201cinaccurate\u201d and that \u201cthe facts presented target him and easily allow for his identification.\u201d When contacted by RSF, Giroud responded, \u201cMy client has asserted his rights, in Switzerland and abroad, in order to defend himself against unfounded accusations made against him, as any unjustly accused individual would.\u201d She added that Khare \u201cdoes not wish to comment on the initiated proceedings and is leaving it to the courts.\u201d<\/h5>\n<blockquote class=\"wp-embedded-content\" data-secret=\"2c1DI84Pfo\"><p><a href=\"https:\/\/pakistanintheworld.pk\/live\/pakistan-in-the-world-october-2024\/\">Pakistan in the World \u2013 October 2024<\/a><\/p><\/blockquote>\n<p><iframe class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"&#8220;Pakistan in the World \u2013 October 2024&#8221; &#8212; Pakistan In the World\" src=\"https:\/\/pakistanintheworld.pk\/live\/pakistan-in-the-world-october-2024\/embed\/#?secret=lhkUfYooIP#?secret=2c1DI84Pfo\" data-secret=\"2c1DI84Pfo\" width=\"600\" height=\"338\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<h5 dir=\"ltr\">Despite the potential consequences,\u00a0<strong><em>Gotham City<\/em>, like\u00a0<em>The New Yorker<\/em>,<\/strong> decided to continue publishing. According to our investigation, at least four other media outlets and public interest organisations have also refused to give in to these threats. In Canada, Ronald Deibert, the director of Citizen Lab \u2013 a laboratory that specialises in analysing cases involving online surveillance, cybersecurity and human rights \u2013 has\u00a0<u>made it clear<\/u>\u00a0that he will not comply with the\u00a0AOATC\u2019s takedown demands.<\/h5>\n<h5 dir=\"ltr\">The next victim of these gag suits may be <strong>French:\u00a0<em>Intelligence Online<\/em>,<\/strong> an outlet that covers news in the intelligence sector, has often taken an interest in Khare and Appin. In a letter to\u00a0<em>Gotham City<\/em>, Giroud confirmed that the French site is the subject of \u201cright-of-reply and defamation proceedings in France,\u201d without giving any further details.\u00a0<em>Intelligence Online<\/em>\u2019s<em>\u00a0<\/em>editor-in-chief Pierre Gastineau confirmed the existence of a legal complaint.<\/h5>\n<h5 dir=\"ltr\">Khare\u2019s strategy is impressively ambitious, as he went so far as to hire Clare Locke LLP, a US law firm that specialises in defamation cases against print, broadcast, and online media outlets. Clare Locke contacted major American outlets demanding they take down\u00a0<u>content<\/u>\u00a0about Khare\u2019s international censorship campaign, such as\u00a0<u>this <\/u><u>article<\/u>\u00a0by the tech and science magazine\u00a0<em>Wired<\/em>.<\/h5>\n<h5 dir=\"ltr\" style=\"text-align: center;\"><strong>AOATC: an opaque organisation<\/strong><\/h5>\n<h5 dir=\"ltr\">Many media outlets, including\u00a0<em>The<\/em>\u00a0<em>New Yorker\u00a0<\/em>and\u00a0<em>Reuters,\u00a0<\/em>have been contacted or sued by the AOATC, even though this entity is not mentioned in their investigations. The AOATC seems to systematically contact and sue media outlets that discuss Appin and Khare, even though the organisation presents itself as an \u201cautonomous body\u201d that supports and manages training centres operating under the Appin franchise.<\/h5>\n<h5 dir=\"ltr\">On 3 October 2024, during the lawsuit against<strong><em>\u00a0Reuters<\/em>,<\/strong>\u00a0<u>even the Indian judicial system<\/u>\u00a0questioned the legitimacy of AOATC\u2019s complaint, pointing out that it was only created in 2022 and would therefore not be concerned by the claims made in the\u00a0<em>Reuters<\/em>\u00a0article, which reported on events that took place several years prior. RSF reached out to the AOATC several times, in particular about its links with Khare, but it did not respond to our interview requests. However, his lawyer, Capt,\u00a0said Khare \u201chas no links with this association.\u201d<\/h5>\n<h5 dir=\"ltr\" style=\"text-align: center;\"><strong>Online cleansing<\/strong><\/h5>\n<h5 dir=\"ltr\">In addition to the letters and complaints, other tactics have also been used to protect Khare\u2019s online reputation.\u00a0<em>Gotham City\u00a0<\/em><u>reported<\/u>\u00a0that an<em>\u00a0Intelligence Online<\/em>\u00a0<a title=\"article - ouverture dans un nouvel onglet\" href=\"https:\/\/rsf.us7.list-manage.com\/track\/click?u=5cb8824c726d51483ba41891e&amp;id=76f36ba831&amp;e=10c4d6b1bc\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/rsf.us7.list-manage.com\/track\/click?u%3D5cb8824c726d51483ba41891e%26id%3D76f36ba831%26e%3D10c4d6b1bc&amp;source=gmail&amp;ust=1733209114990000&amp;usg=AOvVaw3svjgkqdJ5S1kHfkHug5TK\"><u>article<\/u><\/a>\u00a0was the subject of an abusive takedown request under the Digital Millennium Copyright Act (DMCA), the US digital copyright law. After being copied onto an Indian website and backdated, the original article was flagged as a copy in an attempt to have it removed. This is not the first time this US law has been misused to censor reliable journalism; RSF has\u00a0<u>reported<\/u>\u00a0on the topic before.<\/h5>\n<blockquote class=\"wp-embedded-content\" data-secret=\"38gQyLiRmB\"><p><a href=\"https:\/\/pakistanintheworld.pk\/live\/india-newsclick-case-in-india-rsf-and-guernica-37-chambers-call-on-the-european-union-to-sanction-delhi-police-officers\/\">INDIA : NewsClick case in India: RSF and Guernica 37 Chambers call on the European Union to sanction Delhi police officers<\/a><\/p><\/blockquote>\n<p><iframe class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"&#8220;INDIA : NewsClick case in India: RSF and Guernica 37 Chambers call on the European Union to sanction Delhi police officers&#8221; &#8212; Pakistan In the World\" src=\"https:\/\/pakistanintheworld.pk\/live\/india-newsclick-case-in-india-rsf-and-guernica-37-chambers-call-on-the-european-union-to-sanction-delhi-police-officers\/embed\/#?secret=UCGnp9eDYJ#?secret=38gQyLiRmB\" data-secret=\"38gQyLiRmB\" width=\"600\" height=\"338\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<h5 dir=\"ltr\">Although Khare and the AOATC seem determined to suppress all investigations into Appin, the Indian cyber-entrepreneur maintains a strong online presence. The first page of results from a Google search of \u201cRajat Khare\u201d included several posts portraying him in a much more favourable light, such as\u00a0<u>this article<\/u>\u00a0posted on the open publishing platform\u00a0<em>Medium<\/em>. RSF discovered a slew of similar posts, some in the form of\u00a0<u>posts<\/u>\u00a0or\u00a0<u>op-eds<\/u>\u00a0under the entrepreneur&#8217;s byline.<\/h5>\n<h5 dir=\"ltr\">But most of this content was authored by accounts with\u00a0<u>generic<\/u>\u00a0<u>names<\/u>\u00a0accompanied by photos created by artificial intelligence, each one commenting on posts by the others. A\u00a0<u>biography<\/u>\u00a0of Rajat Khare has been commented on and liked 300 times by only six profiles, five of which post content about Khare. One of the\u00a0<em><u>Medium<\/u><\/em><u>\u00a0accounts<\/u>\u00a0displays the same profile photo as a\u00a0<u>different author<\/u>\u00a0on the platform\u00a0<em>Vocal Media<\/em>, and both write solely about Khare.<\/h5>\n<h5 dir=\"ltr\">RSF tracked down one of the authors of the articles praising Khare. He recognised having written his content \u201cwith the help of Chat GPT,\u201d but did not wish to explain why he used a pseudonym. When asked about his motives and whether he had any links with Khare, he replied that he had written the articles for personal reasons, enigmatically adding, \u201cNot everything is in my hand.\u201d<\/h5>\n<h5 dir=\"ltr\">Profiles with user names referring directly to Khare, such as <strong>\u201c<u>RajatKhareLuxembourg<\/u>\u201d<\/strong> and \u201c<u>RajatKhareInvestor1<\/u>\u201d, were posting these types of articles on\u00a0<em>Medium<\/em>\u00a0as far back as 2022, praising Khare\u2019s career as a tech entrepreneur and his skills as an investor in a clear attempt to flood the Internet with this content and drown out the troublesome investigations.<\/h5>\n<blockquote>\n<h5 dir=\"ltr\" style=\"text-align: center;\"><strong>Is Khare behind all these flattering articles, which \u2013 unlike the journalistic investigations \u2013 do not appear to have been subjected to hostile litigation?
