I noted 16 years ago after the restoration of judiciary that now here will be Two Chiefs ; Army Chief and Chief Justice of Pakistan. That time General Musharraf was President as well as Army Chief and CJP restored was Justice Iftekhar Ch. Present CJP Bindyal could not control his excitement finding Imran Khan in his court but that is another matter. CJP is already controversial for his continued tilt towards Imran. Here after 3 days and nights of destruction by PTI workers in the country is important to see CJP is right in obliging Imran by giving him extraordinary relief or he is wrong. Further , his ruling is in accordance with law or he has sent a strong message to Military, proving himself another Chief of the country?

Judiciary’s out of way “Justice” – Why?

The arrest of Imran was legal or illegal? The judiciary unitedly thwarted the attempt made by military? Military went to back foot? Lets see what happened with the move by the military. The arrest was not illegal but actually it was accomplished in very wrong way. legal community was shocked at how the arrest operation was conducted. What the military failed to judge was the unwritten tradition that a criminal is not arrested from the chamber of a common lawyer even. Here a political leader was arrested from not a lawyer’s chamber but from within the vicinity of a high court where the wanted gentleman had surrendered himself to the court.

The arrest in this way actually challenged the writ of the judiciary even if the military did not know it. Now when the judges took it as intervention into the judicial sanctity, they set aside their own internal differences and joined forces to teach a lesson to those who used force inside the judicial premises. It was more saving their own tradition than protecting the law. Here it became matter of upholding of the judicial writ rather than looking at it as legal or illegal. That is why CJP heard the case along with Justice Ather Minallah , who otherwise is considered to be in anti CJP camp. He agreed with CJP about terming the arrest as illegal act in the same line what has been shared above.

CJ IHC Jutice Amir Farooq first day , 9 March ruled the arrest was legal after reserving the ruling. Certainly he asked someone (everyone knows who) what ruling he should issue. Later he ruled it as legal. The rangers broke into the premises of high court by breaking the glasses of the court building. Such type of arrest can be termed as legal only when there is some push from some powerful side. But on 12 May , the same CJ IHC was showering the bails in all cases including that can be registered in future (The one and only example set in the history of judiciary)

Military’s Bad Blow – Judiciary’s Back Blow

Military tried to strike a strong blow to Imran Khan for his continued out of crease statements against the officials of the Military but bad management and worst designing of the operation made the move a Blow Back that was more damaging to the sacred institution. It is not new by the way. Project Imran is continuously blowing back and there is no saving and retreat is the only option left.

I have noted many times that it is just like the Bollywood movies in which the Mafia first creates a monster in the laboratory to destroy the opponents but the monster goes out of control and then the same creators go on to finish their own creation, The Monster.

All Exposed

Interesting to observe here is , everyone stand exposed. Imran Khan came to court in wheel chair but was seen walking conveniently after the arrest. Military found cutting a sorry figure for failure of the arrest plan. National Accountability Bureau, the case of whose was the basis of the arrest, remained the most irrelevant authority in whole drama continued from 09 to 12 May. Higher Judiciary lost its repute by expressing its inner for the skipper. CJP’s remarks for Imran were nothing more than the appreciation of a commoner for a celebrity. CJ of IHC came out as man of no stance of his own.

Who is Responsible for Deaths & Destruction

Here too, all stand exposed as no one is ready to accept responsibility for what happened to the state, state institutions and the public. Indian channels reported more than 40 deaths. BBC reported few with references of names and cities. Unfortunately, neither the state media nor the private channels of Pakistan bothered to bring the facts on record.

Mainstream media is known as divided between PTI and anti PTI. It accepts the advice from the powerful , gov or military or PTI, whatsoever. The truth was lost in between these players and their followers. A metro station in Rawalpindi, Radio Pakistan in Peshawer, Corp Commander house in Lahore and many other properties of gov , military and the public were attacked and destroyed.

Neither CJP Bindyal nor CJ IHC Amir Farooq felt the need to touch that aspect as well and issue some ruling in this regard. Neither the government announced any inquiry commission and compensation for the commoners who lost their belongings or lost their loved ones in the savage attacks of the PTI workers.

Democrats or Fascists

Political leaders have been arrested most often in Pakistan on different charges including corruption, misuse of powers, nepotism, assassination attempts and traitory. The political parties have never reacted in a way PTI is reacting. Arrest and Jails are routine matters for politicians in Pakistan. Imran Khan’s arrest is no different than the arrests of Asif Zardari and Nawaz Sharif but PPP and PMLN workers did not close the highways and never attack the state buildings, police stations and military officials.

There are many cases on Imran Khan as are against Asif Zardari and Nawaz Sharif and Shehbaz Sharif and Mariyam and Hamza and many others. In case of later, their female family members have also seen arrests and jails. Then why so much hue and cry on the arrest of Imran? And he has been arrested only. He has not been thrown away in jail for months and years like others were when Imran was PM. Last but not the least, he has not been assassinated like BB or not hanged like Bhutto or not disqualified and sent to jail with his daughter like Nawaz.

When BB was murdered in Rawalpindi, A military dictator was the head of the state. But PPP workers did not hit the military installations or offices and houses. Yes there were agitations and subversive activities in Sindh but in two days only the situation became calm when Asif Ali Zardari sent message to angry workers that ” Pakistan is Needed”

Dirty Harry & Dirty Politics of PTI

Now when the workers of Imran Khan are in agitation mode and they are breaking the law and order throughout the country and Imran is only arrested , he has not been assassinated, the nation is looking towards him that when he will prove himself a leader by directing them not to close the roads and not to attack the officials and state institutions and not to disturb or loot the commoners. BUT Khan sahib again threatened that the same will be done if he is arrested again. It is like a leader of the nation or it is like a mafia don?

Imran Khan blames Maj Gen Faisal Naseer as behind the notorious acts against him (Imran). He calls names for Maj Gen as Dirty Harry but his own irresponsible reaction on the deaths and destruction in the country by his own supporters is enough to reach the result that he himself is doing Dirty politics. Dirty is not only Harry but Dirty is the politics of Imran Khan as well.

Murghi Haraam in Two Mullas

The government of Pakistan and especially Military were trying their best not to touch Imran Khan to avoid what is happening now in Pakistan. But Imran Khan was continuously hitting both mostly below the belt. Government was looking towards Military and Military was looking towards government to fix Imran Khan and Imran was taking advantage of the situation. Courts were the hope for both of them but here they found disappointment most often. Courts were continuously giving relief to Imran Khan.

There is a saying in Urdu that ” 2 Mullaon me Murghi Haraam” (Hen is Haraam when two Mullas are around). Same is the situation with the government and the military. Both want to eat the hen but both want that the hen is caught by the other but no one wants to take risk. Therefore both are failed and finally both go away saying Hen is Haraam. Now lets see what the Hen does with the nation  when it is caught again.

Afghani Element in the garb of KPK Pathans

The situation may not have worsened so far If it was only about PTI workers. Armed groups from KPK can cause a damage that would be irreparable. Actually it is not about KPK factor only. Yes KPK is the stronghold of PTI and the people of KPK especially the youth is more aggressive than the people of other provinces. KPK people keep arms in routine life. This is no doubt alarming scene but more to concern is another factor and that is Afghani element.

Afghanis are living in KPK and in the suburbs of Rawalpindi Islamabad in big number. Many of them present themselves as pathans of  KPK. Many of them are already active in the real estate sector in twin cities. The housing societies have hired them for occupying the lands around their sites. These Afghanis have weapons and do not hesitate to fire and kill. Now the groups of Afghanis and KPK pathans and Afghani already present in twin cities are ready to clash with the police. One can easily reach the result. The police will certainly run away to save their lives. Then come rangers and military. The mob can not be controlled without military operation and military operation can bring dire consequences for the state.

Here it is worth noting that Afghanis’ large presence in Pakistan and especially in twin cities is not something secret. Our own departments are responsible for registration of the Afghanis as citizens of Pakistan.They take bribe and issue the ID and permission to live and do whatever they want. Afghanis are now stronger than the locals in twin cities. They have properties of billions of rupees. They purchase properties and rent the houses on more rates than the locals. Police provide them cover. If law and order situation is deteriorating in twin cities, it is mainly because of Afghani criminals.

Al-Qadir Trust case by NAB

About £190 million ( approximately Rs 60 billion) of Malik Riaz Hussain of Bahria Town transferred through money laundering were caught in the United Kingdom. The UK government contacted the Pakistani authorities regarding the amount’s return.

As per law, the amount belonged to the Pakistani nation and should have been deposited in the national exchequer. Instead (the then advisor to the prime minister) Shehzad Akbar acting as a front-man, got formed the Al-Qadir Trust under a deal executed by him.

458 kanal of land in Sohawa and another 240 kanals in Bani Gala were registered in the name of Al-Qadir Trust. PTI chief and his wife Bushra Bibi were the only two trustees of the Al-Qadir Trust.

240 kanals of land in Bani Gala, worth around Rs 5-7 billion, was got registered in the name of Farah Gogi, a close friend of Imran Khan’s wife, while Shehzad Akbar had also taken Rs 2 billion for his services.

Instead of bringing Rs 60 billion into the national treasury, the amount landed in the bank account of the Supreme Court, where the accused property tycoon was under trial. The amount was, in fact, returned to the accused in a complex manner to hoodwink the masses. Even the apex court did not question the source of the amount and why it was returned to Pakistan by the UK.PTI chief and his wife obtained billions of rupees and land worth hundreds of kanals from Malik Riaz Hussain for legalising Rs60 billion that was identified and returned to the country by the UK during the previous PTI government.
